This website is operated by Appletons Animal Housing and Pet Supplies (Appletons) also known as Chooks. Throughout the site, the terms “we”, “us” and “our” refer to Appletons. Appletons offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

SECTION 1 - ONLINE STORE TERMS By agreeing to these Terms of Service, you represent that you are at least the age of majority in your region of residence, or that you are the age of majority in your region of residence and you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 - GENERAL CONDITIONS We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 5 - PRODUCTS OR SERVICES (if applicable) Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates so that we can complete your transactions and contact you as needed. SECTION 7 - OPTIONAL TOOLS We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

In no case shall Appletons, our directors, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SECTION 14 - INDEMNIFICATION You agree to indemnify, defend and hold harmless Appletons and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference or your violation of any law or the rights of a third-party.

SECTION 15 - SEVERABILITY In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 - TERMINATION The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 18 - GOVERNING LAW These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New Zealand.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

Ordering & Refund Policy

To place an order for any goods you should follow the procedures set out on the shopping cart page of the website, and it is your responsibility to ensure that all details of your order are complete and accurate. Inaccurate address fields can yield incorrect shipping results. On confirmation of order we will notify you as to any changes in shipping, if any. By placing an order you agree to accept our terms and conditions.

Each order shall be an offer by you to purchase goods subject to these terms and conditions. We will not be bound to supply any goods ordered until we have notified you of our acceptance of an order. We are entitled to reject any order and will notify you of any such rejection.

All goods excluding hatching eggs and livestock are delivered with a 30-day money-back guarantee in addition to your rights under the NZ Consumer Guarantees Act. The 30 day right of return starts from the date delivered or items collected in store. To return goods under your money-back guarantee, you must email us at info@chooks.co.nz or inform us in writing and returns must be received back before the end of the 30-day period.
All returns must come back in unused, resalable condition in the original packaging (as new) together with a receipt or proof of purchase.
All Omlet KITSET returns that have been opened will incur a checking and restocking fee. We do not offer refunds on Omlet Fencing. We do not accept returns on products that have been assembled and used.
Please note shipping costs and the cost of returns are non-refundable. If so requested, we may collect the goods being returned but the cost of the collection will be charged to you and may be deducted from any refund given.
If you need to cancel or postpone an order then please give us as much notice as possible. If you place an order and we receive no payment or no reply to our confirmation emails we will follow up with a cancellation email 10 days after the date the order was placed informing you that your order has been cancelled.
All our timber animal housing is made to order. Should you choose to cancel your timber housing order at the last moment and your order is complete we will charge a $250 cancellation fee. All completed timber housing not collected from our yard within 6 months of the order date will surrender the total paid to date on the order - the total paid is not refundable.
Should you cancel your order for hatching eggs there will be no refund. We offer no refunds on livestock.

REFUNDS (if applicable)
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within 7 days.
There are certain situations where only partial refunds are granted (if applicable): Any item not in its original condition, is damaged or missing parts for reasons not due to our error. Any item that is returned more than 30 days after delivery.

From the 1st February 2021 we can no longer absorb the Shopify online card commission fee on cancelled orders. Please note that if you cancel an order or cancel any item on an order and have paid by card we will refund the necessary amount less the 3% Shopify credit card commission fee back to your credit card. This does not apply to orders paid via internet banking.

All quotes are valid for 30 days.

EXCHANGES (if applicable)
We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at info@chooks.co.nz and send your item to: Appletons Animal Housing and Pet Supplies, 270 Mt Heslington Road, Brightwater 7091, New Zealand.
Depending on where you live, the time it may take for your exchanged product to reach you may vary. If you are shipping an item of value you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

General Terms & Conditions

We deliver Nationwide (North and South Islands of New Zealand). Goods will normally be shipped within 1 to 3 working days of us accepting your order. Please expect delivery to be 1 to 10 working days depending on your address from date of shipping. There are no deliveries on Saturdays and Sundays. We offer overnight delivery to North Island town addresses. We will notify you if there are additional shipping costs. Please read our shipping tab (in the footer menu) for full information on our shipping policy. We will contact you by email if delivery is likely to be delayed. All our timber housing is built to order and takes app. 5 to 25 working days between acceptance of order (confirmation) and dispatch.

All goods are advertised for sale subject to availability. In the event of us being unable to supply the goods ordered, we will inform you as soon as possible. Where goods are unavailable for any reason, we may propose to provide you with substitute goods of equivalent quality and price. Should any goods ordered not be available or any substitute goods not be to your reasonable satisfaction, we ask that you return the goods to us at your expense. If you have already paid for the substituted goods or any goods that are not available, a full refund of the purchase price will be given.

All our timber housing is all built to kitset specifications for more cost-effective freighting. All kitsets are flat-packed and shrink-wrapped prior to dispatch. Shipping is an additional cost and will be applied at checkout. Please ensure if selecting delivery to door that trucks have the necessary access. One truck driver is allocated per truck and it is appreciated if the customer can assist with hand unloading if no loading facilities are available. Otherwise please select depot collection. For list of depots please see footer menu. For depot collection your flat-pack hen house will fit comfortably on most standard car trailers. Please remember to leave the cage for the trailer at home and bring tie downs to secure your load. We can assist with local delivery please enquire as to price. We welcome pickups. We are happy to assemble your housing at no additional charge should you wish to pick up.
Please notify us immediately of any issues if your timber housing is delivered damaged. Mark clearly on the delivery docket the damage/loss and call Mainfreight immediately to notify them if not noted on the delivery docket. Please document the damage/loss by taking take photographs prior to removing the shrink-wrap from the consignment. Please call or email Appletons to let us know with 48 hours that there is damage. We cannot lodge a claim after 7 days nor replace any damaged items if we are not notified immediately.

Please note all our timber housing is made to order. We will book your order into production on confirmation of order. Depending on workshop capacity orders can take 7 to 20 working days to manufacture. To keep our timber house pricing affordable and realistic, we use C-D grade structural plywood and rough sawn timber. The nature of this grade ply is that one side is high grade and the reverse side has possible minor blemishes. These can be knots, tiny splits, filler etc, and do not affect or compromise the functionality of the hen house in any way. The high-grade side is put to the outside, so your hen house looks smart. Please have a look at the photos of our hen houses on our website and you will see what the plywood and timber we use looks like. If you would like us to use A or B grade plywood, we can certainly look at this option for you, but it will add substantial cost (double/triple) to your hen house. We need to be mindful we are manufacturing hen and animal housing and need to keep these at an affordable price. Our workshop team build all our timber housing to a high standard within the limits of the materials used. If you require a super smooth finish to the interior of your hen house we recommend applying several coats of paint once you receive it or talk to us about an upgrade using dressed timbers and A or B grade plywood. All timber is H4 treated and H3.2 for the plywood so your hen house has a long life outside in our NZ weather. If you prefer to have untreated timbers, we can look at building out of untreated timber and plywood. This again will add to the cost. Please note we still need to put treated skids on the base. Environmental factors play a huge part in reducing the life expectancy of any product whether manufactured of timber, plastic or metal. All timber housing will weather and silver over time and timber can also move and split. We recommend to reduce this and get longevity from your timber hen house or coop that you give it a coat or two of paint. This will also make a difference with ongoing red mite control. We recommend if you live in an area or suburb that is coastal or prone to sea breezes or salty air you regularly wash your galvanised corrugated iron or coloursteel roof with potable water. Regular maintenance is important. Oil moving parts.

Overtime there is going to be wear and tear on all products that are placed outdoors and exposed 24/7 to the elements.  Environmental factors play a huge part in reducing the life expectancy of any product whether manufactured of timber, plastic or metal. In some parts of New Zealand especially in places where there is greater exposure to weather with a higher salt content corrosion/weathering is going to happen faster. Coastal environments, extreme changes in temperature or a wet/humid environment are the main three factors that will speed up corrosion. 
All Omlet outdoor pet runs, eglu runs and run extensions are manufactured to the same high specifications.  Omlet strives to make the world's best pet products. You should note that some components are made from metal and the coating may need maintenance over time. Regular care and maintenance is important to increase the life of your Omlet pet runs. We recommend regular rinsing with potable water especially if you live in an area or suburb that is coastal or prone to sea breezes or salty air. If rust spots do develop, then you should repair them to give your pet runs the best chance of staying well maintained.
Excessive rusting due to environmental factors is not covered under the Omlet warranty.

Our poultry are not open to the public for viewing. Customers are are most welcome to look at our Omlet range of chicken coops and hutches and view any day old chicks and/or ducklings if we have some in the shop. Our shop is open 5 days a week. Please see our opening hours in the website footer. We do not have any timber animal housing available to view. Thank you.

We are very happy to travel out to your place (if not too far!) and talk to you about your chicken project and plans. Travel time will be charged plus vehicle/fuel charges at $1.50 per km. An Appletons consultation is $120 plus gst per hour.

We can offer layby. Layby is a popular way to buy goods when you can’t afford to pay for them straight away. Your goods are kept at the shop until the whole price (including shipping) has been paid off and no interest is added to the price. You agree to pay for them in three or more equal instalments. Payments are to be made via internet banking.  Payment needs to be on time and the same day each week or fortnight. Payment dates cannot be missed. If the first payment is delayed or postponed we have the  right to cancel the order and not proceed with the layby option. If two or more payments are skipped we have the right to cancel the order and charge an admin fee of $60.00 We do not accept credit card payments for layby. You can cancel a layby before you have finished paying for it or before you take the goods. In this case you can let us know by calling at the shop, writing a letter or sending an email. Should you choose to cancel we will refund your money less a $60 administration fee.
