General Terms & Conditions

1 Orders
1.1 To place an order for any goods you must either: Follow the procedures set out on the Appletons website or speak to an Appletons team member instore or by calling our number. 
1.2 Each order shall be an offer by you to purchase goods or services subject to our terms and conditions.
1.3 By placing an order with us you acknowledge that you are obligated to pay in full for the goods or services ordered once you have submitted your order.
1.4 All prices are displayed in NZ dollars and are inclusive of gst.
1.5 It is your responsibility to ensure that all details you provide to us are true and accurate, including any information saved on our systems used in processing your order. You can update this information by logging into your account. Appletons is not liable for any loss or inconvenience you incur directly or indirectly by incorrect information that you have provided to us.
1.6  Upon completing the checkout process on our website, you will be shown a summary of your order. This does does not constitute acceptance of your order.
1.7 When placing an order with Appletons, you must provide a working contact telephone number and valid email address so we may contact you to address any issues with your order.
1.8 When placing an order with Appletons online you should receive an automated order confirmation. This order confirmation does not constitute acceptance of your order.
1.9 If you receive an invoice or pro-forma invoice from Appletons, this does not constitute acceptance of your order.
1.10 Acceptance of your order occurs only at the point where your order is dispatched from our premises.
1.11 We maintain the right to reject or cancel any order at any point prior to delivery without providing a reason. If you have provided payment prior to this point, we will issue a refund up to but not exceeding the total of your payments as soon as is reasonably possible.
1.12 All goods remain the property of Appletons until such a time that the order has been accepted and we have received full payment of all sums due in respect of your order, including delivery and ancillary charges.
1.13 The goods will be your responsibility from the point where you or your nominated representative (including third-party couriers you have arranged) take physical possession of the goods.
 1.14 We cannot be held responsible for any negligence or misconduct on the part of our carriers and couriers.

2 Communications
2.1 By placing an order with Appletons, you consent for us to contact you in relation to the processing and fulfillment of your order, including follow-up communications to assist us in assessing our performance. This does not include marketing communications, which you may opt out of at any time.
2.2 Email communications will be sent from email addresses in the chooks.co.nz domain and via shopifyemail.com and their associated apps. It is your responsibility to ensure that any email filtering services utilised by you or your email service provider are configured to allow these messages to be delivered normally.

3 Availability and Specification
3.1 All goods are advertised for sale subject to availability. In the event of us being unable to supply the goods ordered, we will inform you as soon as is reasonably possible.
3.2 In the event that items are out of stock but more stock is expected in the future, we will dispatch your order as soon as we are able.
 3.3 Appletons makes reasonable efforts to ensure that any stock availability information displayed on our website is accurate, but stock figures should be viewed as an estimate only.
 3.4 Where goods are unavailable for any reason we will notify you via email or telephone and offer you the option to go with a substitute of your choosing or you can opt for a refund.
 3.5 If you order medication, cleaning products, general pet health products or other substances where the design of the external container or packaging is not relevant to the functionality of the product, or in the event that that our supplier changes the external design of the packaging, we reserve the right to supply the same product in alternative packaging.

4 Colours, Sizes and Measurements
4.1 All sizes, colours, and measurements shown on our website are approximate.
 4.2 We cannot be held liable if the appearance or experience of any product featured on our website differs from that which is intended when viewed on your computer, tablet, phone or other device.

5 Delivery
5.1 We use Post Haste Couriers to deliver all our courier orders and Mainfreight delivers all larger consignments.
5.2 Any delivery date provided to you is an estimate only. We cannot guarantee a particular delivery date and accept no liability for any costs or inconvenience incurred if your order arrives before or after this date.
 5.3 When your goods have been dispatched we will attempt to notify you via e-mail. In addition, our courier may send you an e-mail notifying you of your tracking number and that your order has been picked up.
5.4 Appletons cannot be held responsible for any delivery estimates provided to you directly by our couriers.
 5.5 Our couriers will make reasonable efforts to deliver your goods.
 5.6 If you are aware of any reason why access to the delivery address may be restricted or difficult for our courier, it is your responsibility to inform us at the point where you place your order.
 5.7 It is your responsibility to ensure that someone is available at the delivery address to accept the goods. We cannot accept any liability for costs or inconvenience incurred if no-one is present at the delivery address when our nominated delivery service attempts to deliver your order. In the event that our courier is unable to deliver your goods because you are not present, you may be held liable for any additional delivery charges incurred.
5.8 We cannot be liable for any delays or failures to deliver good or services if the delay or failure is partially or completely caused by circumstances outside our control.
5.9 If you request that your order be left at the delivery address without obtaining a signature, this is done by our courier at their discretion and cannot be guaranteed.
5.10 If you request that your order be left at the delivery address without obtaining a signature, you are considered to have taken physical possession of the goods at the moment they leave the courier’s possession.
 5.11 Any delivery costs displayed on our website, or in any communications between you and Appletons up to the point of order acceptance should be considered an estimate only.
5.12 Our shipping APIs will calculate shipping costs at checkout , however, due to various reasons, these can calculate incorrectly. Appletons have the right to recalculate shipping and adjust as required. Customers will be notified via email if there are any additional shipping costs to pay.
5.13 In the event that we incur additional expenses due to you providing incomplete or misleading information, we reserve the right to recover those costs from you at any time.

6 Postage and Packing
6.1 Unless otherwise stated, postage and packing will be charged in addition to the price of the goods themselves and will vary according to the delivery address, weight and size of the goods ordered.

7 Payment
7.1 Full payment for any goods ordered must be made by credit, debit card or bank transfer in advance of delivery. We do not accept cheques. All prices are in NZ dollars.
7.2 If you have provided credit or debit card details, we will debit your card in advance of the dispatch of your order. We reserve the right to take payment at any point from the moment you make an offer to purchase goods or services from Appletons.

9 Pricing
9.1 While we always try to make reasonable efforts that the prices displayed on our website or promotional materials are accurate, we accept no liability for any errors or omissions.
9.2 If through some error an item has been listed at a lower price and you order that product, we will contact you as soon as we are able so you can accept the correct price or cancel your order. If we are unable to contact you, we will cancel your order. If you choose to cancel your order, we will issue you with a refund not exceeding the total of your original payment.

10 Your Right To Cancel 
10.1 All goods (excluding livestock and certain specified products) are delivered with a 30-day money-back guarantee in addition to your rights under the NZ Consumer Guarantees Act. The 30 day right of return starts from the date delivered or items collected in store.
10.2 If you elect to cancel your order, you must return any items received in accordance with the policy below (‘Returns’).
10.3 In the event you return goods under this provision and we discover that they have been used, we may choose to make appropriate deductions from your refund.
10.4 Please note that perishable items such as food (including pet food such as chicken food or treats) and medications are specifically excluded from this policy, except in cases of faulty or damaged goods as described below.

11 Order Cancellations
11.1 If you wish to cancel an order, you must notify us via e-mail or telephone as soon as possible.
11.2 If your order has already been passed to fulfillment for processing, we may be unable to prevent it from being dispatched. In this event, you will receive the goods and should arrange to return them in accordance with the policy below (‘Returns’).
11.2 If you place an order and we receive no payment or no replies to our emails we will follow up with a cancellation email 10 days after the date the order was placed informing you that your order has been cancelled.
11.3 All our timber housing is made to order. If you wish to cancel your timber housing order and your order is already in production, we charge a $250 cancellation fee. No returns  on timber housing and enclosures after shipping.
11.4 All completed timber housing not collected from our yard within 6 months of the order date will surrender the total paid to date on the order. The total paid is not refundable.
11.5 If you cancel your order for hatching eggs there will be no refund nor do we offer offer refunds on livestock.
11.6 If you cancel your pre-order for brown shaver pullets you will be charged a cancellation fee of $5 per pullet. Plus a Shopify payments transaction charge of 3.6% per order if your payment is made online by card.

12 Faulty or Damaged Goods
12.1 If goods are found to be faulty or damaged upon delivery, are not as described please contact Appletons immediately. Please check all parts are accounted for in the Omlet kitsets if you do not plan to assemble shortly after receipt. We accept a reasonable timeframe (3 months) to be notified.
12.2 For all damaged timber housing deliveries please contact us and Mainfreight immediately. For full details click here 
12.3 It is always our preference to work with customers to resolve any issues with their products by providing a repair or replacement.
12.6 All faulty or damaged goods must be returned according to returns procedure below.
12.7 In the event that any of our products are placed in direct sunlight for extended periods of time, some fading to colours may occur. This is a natural process and does not indicate a product fault.
12.8 Products must be assembled and used in the manner described in the instructions provided.
12.9 Appletons is not responsible for any ancillary damaged caused by the improper use or assembly of products.
12.10 All livestock sold is given a full health check prior to sale.  We are not responsible for and do not replace any losses due to illness/death once the birds are in your care. Please note birds moving to a new home, new environment and new routine will be exposed to new pathogens. Birds can get stressed resulting in a reduced immunity which can make them more susceptible to bugs and diseases which they would not have not been exposed to in their original environment.
12.11 Our livestock does not come with any guarantees as to how early or late, how often and how many eggs they are going to lay. (Yes, some hens may never lay.  Hens have only one working ovary, so if something happens to it you won't get eggs. This is very rare but it can happen.)

13 Returns
13.1 Prior to returning items to Appletons, you must obtain a return authorisation by contacting us either by telephone, via email at info@chooks.co.nz or by writing to us at the address below. We will not process any returns sent directly to us without prior authorisation. 
13.2 Any goods returned to us for refund must be in new unused condition in original packaging together with receipt of purchase and be returned within the 30 day window.
13.3 All Omlet KITSET returns that have been opened will incur a checking and restocking fee.
13.4 We do not offer returns and refunds on Omlet Fencing, Omlet Covers, Heat Emitters, Medications and Livestock.
13.5 We do not accept returns on products that have been assembled or assembled and used.
13.6 Please note shipping costs and the cost of returns are non-refundable. If so requested, we may collect the goods being returned but the cost of the collection will be charged to you and may be deducted from any refund given.
13.7 After receiving authorisation for a return, you must ensure that all items to be returned are securely packaged in either their original packaging or equivalent. Appletons cannot be held responsible for any damage, loss, or costs incurred due to inadequate packaging.
13.8 All packages returned to us must be clearly marked with your order number, and with a slip of paper in each box displaying your name, contact telephone number and order number. If you return items without providing reasonable identifying information, this is done entirely at your own risk and we cannot accept any liability in event that we are unable to locate your return.
13.9 Upon receiving authorisation for a return, Appletons will either provide a Post Haste return label or arrange for collection of the items via our Carrier. If you choose to arrange your own courier, this is done entirely at your own risk and at your own cost.
13.10 It is your responsibility to obtain proof of postage or a collection receipt. In the event that any dispute arises as to whether the designated courier has collected items to be returned and you are unable to provide proof of postage, we will be unable to accept any liability.
13.11 We will endeavour to refund you for items returned within seven working days of Appletons receiving the goods, but in any event within 14 working days. 

14 Refunds
14.1 From the 1st February 2021 we can no longer absorb the Shopify online card commission fee on refunds and cancelled orders. If you wish to cancel an order or cancel any item/s on an order or have return item/s and have paid by card we will refund the necessary amount less the 3.6% Shopify card commission fee back to your card. This does not apply to orders paid via internet banking.

15 Quotations
15.1 All quotes are valid for 30 days.

16 We do not offer any Layby or Afterpay options.

17 Privacy
17.1 We will attempt to make all reasonable efforts to keep your personal details, the details of your order, the details of your payment and any other information we hold about you secure.
17.2 When creating an account, we may create a password for you, or you may be asked to enter a new password. In the event that you are asked to create a new password, you must not use this password for any other purpose. It is your responsibility to maintain the secrecy of your password and other information. Appletons cannot be held liable for any inconvenience or loss that occurs as a result of any failures by you to protect your details, password or other Appletons Website account.

18 Viewing of Poultry
18.1 Our poultry is not open to the public for viewing.
18.2 Customers are are most welcome to look at our Omlet range of chicken coops and hutches on display .
18.3 Our shop is open 5 days a week. Please see our opening hours in the website footer.
18.4 We do not have any timber animal and hen housing on display. Thank you.

We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
